01 — What we do

We keep track of the deadlines so that the insolvency does not get worse

In insolvency almost everything is measured in dates, and none of them can be recovered afterwards.

We keep track of the deadlines so that the insolvency does not get worse

Duty to apply for insolvency

2 months
From when you know you are insolvent; failing to do so is what makes the classification worse later.

Notice of negotiations

3 months of protection
It halts enforcement against the assets the business needs while you negotiate and suspends the duty to apply for insolvency.

Clawback period

The previous 2 years
We review the transactions of that period, which are the ones that can be set aside in the insolvency.

Liability for debts

From the ground for dissolution
If you do not call the general meeting or set the dissolution or the insolvency in motion in time, you are liable for what is incurred afterwards; pinning down the date is central to the defence.

Fraudulent disposal of assets

Criminal offence
Defence where you are accused of hiding assets so as not to pay your creditors.

Personal debt relief

After the liquidation
For an individual, the discharge of unpaid debt closes the process.

03 — Warning signs

Signs that it is time to act

None of them is serious on its own. Several at once usually signal insolvency.

Debts with the tax authority or social security

Deferrals stacking up, or contributions left unpaid so that wages can be met.

Wages paid late

Paying the workforce late is one of the last things that happens before you cannot pay at all.

Seizures and claims

Creditor demands, orders for payment or account seizures that start to pile up.

Working capital funded by credit lines

Credit lines and cards at their limit to cover running costs, not investment.

Suppliers asking to be paid sooner

When the market stops giving the company credit, it usually knows something the accounts do not yet show.

Losses bringing net assets below half the capital

It is a statutory ground for dissolution and it opens up the director's liability if they do not act.

04 — Questions

What people ask us before they instruct us

When it cannot meet its obligations as they fall due. From when it knows, or should have known, it has two months to apply; doing so late is one of the reasons the classification gets worse afterwards.

They can be liable for the debts arising after the ground for dissolution if they do not call the general meeting or set the dissolution or the insolvency in motion in time, and also if the insolvency is classified as culpable. Acting in time and documenting the decisions is the best defence.

Hiding or moving assets so that creditors cannot be paid. It is a criminal offence. If you are accused of it, we review the transactions and the commercial reasons behind them.

Yes: the notice of negotiations and restructuring plans allow you to negotiate with creditors with protection against enforcement, provided the business is viable.

Who we act for in insolvency problems

Both organisations and individuals. Sometimes, through a combination of circumstances, a person's debts far exceed their ability to meet them. Or meeting them means a standard of living that is not dignified. That is reflected in the Spanish Second Chance Act. Would you like to find out whether you meet the conditions to use it? Write to us or call us and one of our lawyers specialising in insolvency support will look at your situation in detail. If you do meet them, we will take care of it ourselves.

What solvency problems there can be

There are as many insolvency situations as there are people and companies that fall into them. As we said above, the particular features of each case mean that lawyers dealing with criminal insolvency have to set out and put in place tailored plans of action. There are, in any event, a number of possible tools that can be useful, such as refinancing the debt, insolvency proceedings or corporate restructuring. Before taking any decision, consult a team of lawyers who are prepared and committed. The difference can be enormous.

Insolvent companies

Companies become insolvent when they do not have enough capital to meet the debts they have taken on. In those situations, some of the tools already mentioned, such as corporate restructuring or insolvency proceedings, can work as a way out.

There are also other routes, such as a third party acquiring the company or its debt, or refinancing. Our lawyers are also at the company's disposal to sort out liability between directors, board members and senior managers. We get to the bottom of the matter.

Individuals without means

Individuals without means can be under a great deal of stress. Pressure from creditors can be very aggressive and take over their lives. Debt demands sometimes exceed what a person can pay and leave them financially vulnerable. That is where the Second Chance Act comes into its own. Get in touch and we will work to give you the fresh start you deserve. To give you peace of mind. So that you can begin again. We will exhaust every avenue open to us.
